ENTERPRISE, Ala (WDHN) — New information and possible evidence have been subpoenaed in the lawsuit filed against the Enterprise Board of Education and an elementary school principal after being accused of neglecting the safety of a child who was hit by a truck.

In October, Jessica Basset, the mother of the victim, 6-year-old Frankie Bassett, filed a lawsuit against the Enterprise Board of Education and Pinedale Elementary School principal Harrison Mims, accusing them of breaching their duty and neglecting her child, which Jessica claims led to her son being hit by a truck and caused traumatic brain injuries.

Subpoenas have now been filed requesting any footage of Frankie on the day of the incident, including the school’s security footage which allegedly shows Frankie leaving the school alone.

In addition, it requests the bodycam and dashcam footage from any responding officers at the scene and officers at the elementary school on the day of the accident, as well as any reports or witness interviews related to the incident.

Alyssa Enzor Baxley, attorney for Jessica Bassett, says the Enterprise Board of Education has been served a copy of the lawsuit, but no one has reached out on behalf of the Enterprise BOE. They have thirty days to respond to the complaint.

A request has also been filed for the minutes of an emergency-called Enterprise Board of Education meeting that happened after the incident
