ELBA, Ala. (WDHN)—A wrongful death lawsuit has been filed in Coffee County’s Circuit Court
against the Elba Nursing and Rehabilitation Center.

In the suit, it states 86-year-old Benjamin Smith was in the care of the nursing and rehab center
when he fell fracturing his leg in October 2020.

In the coming weeks, the Elba resident’s health continued to “deteriorate” until his death about a month later.

Birmingham attorney, Perry Shuttlesworth, Junior, filed the lawsuit on behalf of the deceased man’s widow,
Dorothy Smith.

The suit asks for a jury trial in Coffee County Circuit Court. It requests damages in an amount that will adequately reflect the “wrongfulness” of Smith’s death, and prevent this from happening to anyone else at the Elba Nursing and Rehab Center.

WDHN was unsuccessful in getting a comment from Elba Nursing
and Rehabilitation center regarding the lawsuit filed against them.
